PRIVACY STATEMENT

for IMAGEINATION Services at Imagenisis.net

IMAGEINATION will take the steps described to protect the information presented by Customers engaged in the services at www.imagenisis.net according to required security practices, the wishes indicated by Customers at application and /or by Customer release. As much of the image work is customized, there may be opportunity for special requests that can be taken care of on an individual project basis, usually confirmed with Customer consent on forms or by email.

Privacy issues are reviewed according to the following:

• Collaboration - information gathered and exchanged during the course project development.
• Instruction - information presented to participants in one-on-one or group settings, onsite or online
• Customer order forms - invoices, and payment information
• Customer Accounts - detail at PayPal.com by customer request
• Authorized Signature - for project development and payment processing

Collaboration

Collaboration with Customers begins with the information provided on the Custom QUOTE - a survey of interests and project needs or other form of application. SUBMIT APPLICATION sends information to be used by the assigned artisit(s) to develop a cost estimate for the project. Following Customer agreement, more detailed communication can occur online or by telephone to produce a detailed project proposal and invoice. Records of the information exchange will be maintained on-line until project completion. Records will be stored on disk for two years.

Instruction

Instruction is provided by agreement or formal contract in one-on-one sessions, onsite or online. Information gathered as part of registration for instruction, including name, address, email address and phone numbers is for making contact and use during instructions. This information will be stored in protected files and/or on disk, Registration information will only become a part of a mailing list - postal or email - with the permission of the participant. Security for payment information is the responsibility of the collector of payment , if payments are not made directly to Imageination.

Authorized Signature

Authorized Signature is requested in the form of the Customer entering first and last names of those authorized to provide information or grant permissions and then indicating by check mark that the information can serve in place of the written signature. Alternative signature submission can be completed by fax. These signatures remain on active file, authorizing activity, payment process sing, or other "custom" functions throughout the course of project development (for example: permission is sought by authorized signature for engaging watermarking services for an image or group of images). Authorized signature information, once submitted and on file, dictates that no other individuals can represent the Customer for the activity described. Authorized signatures will be sought for each project. Storage is on disk with relevant records for two years.

Customer LogIN

Customer LogIN is a privacy option offered customers at imagenisis.net. With submission of ID and Password information customers will have access to a restricted area in order to communicate password-protected. This is an alternative to email attachements of files for review and approval during project development. Access is provided when ID/Password information is provided at Custom QUOTE, ADV - advertising options, and other projects of a complicated nature. Access to this area is discontinued at completion of the customer's project.

Form Submission

Form Submission is accomplished with secure internet connection (SSL). Customer information submitted on forms will be stored for reference until completion of a product/project. Information will be stored off-line with related financial records for two years, as required. Other storage arrangements can be arrived at with the Customer, as needed. Form information is not housed on a database or shared for marketing purposes without consent of the Customer.

Customer Order Forms

Customer order forms, invoices and identifying (ID) payment information for credit card processing are protected by the secure payment processing services of PayPal with VeriSign. Financial records identified by Project ID# are stored under protection, by Imageination for two years, as required. Invoices are provided for Customers at intervals dictated by specifics of a project - usually a deposit at initiation and balance payment at approval of DRAFT. Subscription orders are maintained at Imageination. Payment detail, including credit cart and shipping infomration are maintianed ant PayPal. Financial records are accessible online by the Customer until payment completion. Financial records will be stored for two years.

Customer Account Information

Customer account information and account numbers are transmitted and maintained securely from the IMAGEINATION account managed by PayPal. Online payment transmission is protected by VeriSign. Billing by direct invoice - USMail or in person - and paid by cash or check have online records at IMAGEINATION during project development with secure and waterproof storage of documents after project completion. Account information is accessed by identification which includes Invoice and Project ID numbers for reference.

Customer Release

Customers are provided options or asked consent in the form of releases that give permission to Imageination at www.imagenisis.net for:

- Listing and/or hypertext links from imagenisis.net to the Customer’s web project

- Inclusion of Customer contact information on relevant mailing lists and/or sharing of contact in information with affiliates.

- Hold Harmless agreement for the content and release of liability for the success/failure or intent of a project

- Hold Harmless agreement for the content and release of liability for the success/failure or intent of instruction, including equipment - personal computers, monitors, peripherals

- Mention of open source, peripheral choices and other information shared in the course of insturcion and project development are not to be taken as endorsemnt of the product or service.

- Display of the IMAGEINATION (imagenisis.net) logo and hypertext links on Customer projects, indicated “project under development” until project is completed. This display becomes minimized, appearing as reference on completed web-based projects.

- Release for Promotional Consideration formalizes display of projects under development or in complete form that will serve as examples or inspiration to existing or would-be customers of imagenisis.net

Digital Watermark

Customers will be provided the option of protection for special images in the form of digital watermarking services provided by Digimarc, at www.digimar.com. Depending upon the number of images in the project, Digmarc services may be provided on a by image basis or by separate Customer subscription to Digimarc. This protection is offered as a privacy option for Customers with personal photos, artwork, or other images for which privacy is a concern.

EMail Preferences

Customers will be required to indicate eMail preferences by choosng to Opt-IN (yes) or Opt-OUT (no) of receiving eMail authered at or forwarded from imagenisis.net.¹ EMail identified as FYI - memos, notices, project-related information; News - informational text attached to eMail messages; and ADV - advertisement of products, subscriptions, or other purchase opportunities appearing as links withie eMail messages or attached to them.

¹Email preferences are offered in keeping with the enactment of "Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003, or the CAN SPAM ACT of 2003 by the 108th Congress of the United States of America, first session January 7, 2003.

Advertisers

Advertisers whose products and services appear in LINK or ADV Depot, as owners, are responsible for the content of their ads - here referred to as ADV. IMAGEINATION artists and web designers are responsible only for the display of the products and services. Appearance of such advertising at www.imagenisis.net - Custom Image Works - is neither an expressed nor implied endorsement of the products and services by IMAGEINATION. IMAGEINATION reserves the right to discontinue display and link to objectionable content.
